Good news!!! I love to see states stand up to the bully. Like it was said, this is the whole reason why we have protected classes. Minority groups are never going to win a numbers game. Way to go Colorado! 👏🏻
So CHC is ordered to provide care and then they lose all federal funding. They cannot function without federal funding. Can’t the state sue to defend the protected status??? Not sure this is a good thing
CHC has been told that it can't violate state law because federal funding conditions do not supercede state law. If the federal government is making them violate state law, what they need to do is sue over that and do so on the grounds that the funding condition is making them violate state law. It's not a 'reasonable' funding condition (South Dakota v. Dole, 1996), it's a 'gun to the head' (NFIB v. Sebelius, 2012). Especially given that CHC now has a mandate from the Colorado Supreme Court.
So far, it's just been easier for providers to acquiesce. This decision will likely change that. Honestly, I don't think the Trump admin will cut CHC's funding because I don't think they'll push their luck.
Thank you for clarifying! I’m a retired clinical and school psychologist in Colorado. State has some good protections for trans students, but pediatric providers here are worried. CHC receives a lot of research funding from NIH as well.

Yes. Colorado already earns a perfect score on my tracker so that coupled with this and the legislative efforts to circumvent the conversion therapy ruling means that Colorado, as of now, is the safest state for trans kids in the US.

I think a lot of states and legal orgs would be much more willing to defend/expedient in defending care for adults than they are for kids. Many states have protections for it, and although Trump may want to push up the minimum age for adults (as the right has indicated and I’ve reported previously), it’ll be much more difficult to get hospitals to comply than it has been for kids.
